Terms of Use

Next Escape reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on our official website and will take effect immediately upon publication. It is your responsibility to review these Terms and Conditions periodically to stay informed of any changes.

Pricing
All transactions are processed in South African Rand (ZAR).

Published prices for adventure tours and services are subject to change up to 30 days prior to the tour departure. Surcharges may be applied due to increased transportation or fuel costs, additional airport fees, local operator adjustments, currency fluctuations, or changes to government taxes. You will be notified as soon as possible if an increase exceeds 2% of your original booking price. If the increase exceeds 7%, you may either accept the revised pricing or cancel your booking without penalty. However, you must notify us of your decision within 7 days of receiving the notification; failure to respond will be deemed an automatic acceptance of the revised price.

Promotional or reduced pricing may be offered for specific tours or services. These promotional rates are valid for new bookings only and are not applicable to previously confirmed reservations.

Deposits
A non-refundable deposit of 20% of the total booking fee is required at the time of booking. Full payment is required for reservations made 30 days or less prior to the tour departure date. Certain tours or services may necessitate higher deposits or immediate full payment, which will be explicitly communicated prior to booking confirmation.

Bookings
By booking a tour, you confirm that you have read, understood, and agreed to these Terms and Conditions, and that you have reviewed all relevant itinerary details, policies, and conditions provided by Next Escape. Your participation in any tour signifies full acceptance of these Terms and Conditions, which constitute a legally binding agreement between you and Next Escape.

If you make a booking on behalf of other participants, you warrant that you have the legal authority to act on their behalf and accept full responsibility for ensuring each individual is informed of and complies with these Terms. Additionally, you agree to provide accurate and complete information for all party members and to bear all liability for any errors, omissions, or misrepresentations.

You agree to provide accurate, complete, and truthful information regarding your full name, travel documents (e.g., ID or Passport), medical information, and other related details. Please read our Privacy Policy.

Only individuals aged 18 or older may make a booking.

Bookings are subject to payment confirmation, after which an invoice and booking confirmation will be sent via email. A full description of the tour and its itinerary will be provided, and it remains your responsibility to review and confirm that these details align with your expectations.

Cancellations
We understand that travel plans can change, so we aim to offer flexible change and cancellation policies while maintaining a strong relationship with you and our suppliers. To protect yourself against unexpected disruptions, we strongly recommend purchasing comprehensive travel insurance.

Please note:

• A non-refundable deposit of 20% is required to secure a booking.
• Full payment is required 30 days prior to the tour departure date.

If you cancel your booking, the fees are calculated as follows:

• Cancellations more than 30 days before departure: You will receive a full refund of all funds paid, minus the non-refundable 20% deposit.
• Cancellations between 5 and 29 days before departure: You will receive a 50% refund of the total booking fee (the 20% deposit remains non-refundable).
• Cancellations less than 5 days before departure, or a no-show: You will not receive a refund for any funds paid.

Next Escape offers one complimentary tour-date change, provided written notification is received at least 5 days prior to the scheduled tour departure date, subject to tour availability. Once your one complimentary date change has been used, the booking becomes strictly non-refundable. An administration fee may apply to any subsequent changes.

If Next Escape cancels your tour, you may choose between a full refund or the option to reschedule to an available date. Refunds will be processed within 7–14 working days after approval.

Payment
Payment may be made via Card or by Electronic Funds Transfer (EFT), the banking details for which will be provided on your invoice.

All card transactions are processed securely via Payfast by Network, an approved payment gateway for all South African acquiring banks. Payfast utilises advanced, high-level encryption standards to safeguard transaction data, and no card details are stored on their platform. Next Escape does not request, require, or store your card information on our website. Users may visit https://payfast.io/ to view their security certificate and security policy.

Privacy Policy
Next Escape shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “Personal Information” shall be defined as detailed in the Protection of Personal Information Act 4 of 2013 (POPIA). Country of Domicile
This website is governed by the laws of South Africa. Next Escape has selected 3 Lancashire Court, Sherwood, Gqeberha, South Africa as its domicilium citandi et executandi for all legal and contractual purposes, including the receipt of legal notices and documentation.

Medical Information
You may be required to provide medical information. This process may include completing a standard medical questionnaire. Please note that certain high-intensity adventures mandate the submission of this medical form as a strict condition of participation.

Prior to booking, you must fully disclose any pre-existing medical condition that may affect your ability to travel or participate in any adventure activities. You may be required to submit a Medical Form signed by a licensed physician before or at the time of final payment.

You are solely responsible for assessing your physical fitness for travel and participation in any adventure activities. Next Escape does not provide medical advice; therefore, you must consult a physician to evaluate your capability to participate, as well as to obtain guidance on necessary vaccinations, medications, or medical precautions.

Next Escape reserves the right to deny your participation on any tour or adventure activity if your physical or mental condition poses a safety risk to yourself or others, or if you fail to provide the required medical information and completed forms.

Pregnancy must be disclosed at the time of booking. Next Escape reserves the right to refuse participation to individuals who are past 24 weeks of pregnancy, or those whose safety cannot be reasonably accommodated given the strenuous nature of the activities.

Failure to submit the required medical information by the stipulated deadline may result in the immediate cancellation of your booking, with applicable cancellation fees applied.

Important Note: Your Next Escape adventure may take place in remote or underdeveloped regions where access to medical care is limited and may not meet the standards of your home country. Consequently, we cannot guarantee the availability, proximity, or overall quality of local medical facilities. In addition, we strongly advise that you secure travel insurance that includes a minimum coverage of US$200,000 for medical expenses, emergency evacuation, and repatriation.

Special Requirements
Participants with special requirements, such as mobility limitations or other personal needs, must disclose them at the time of booking. While Next Escape will make every reasonable effort to accommodate these requests, certain limitations may arise due to the remote nature of our destinations or the availability of local services.

Food Allergies and Dietary Needs
All dietary needs or restrictions must be disclosed during the booking process; however, we cannot guarantee that every request can be accommodated by our local suppliers.

Age Restrictions and Policies for Minors
All participants under the age of 18 are considered minors. Unless specified otherwise, the minimum age to participate in a Next Escape adventure is 12 years.

• Supervision Requirements: Minors must be accompanied by a responsible adult at all times. A single adult may supervise a maximum of two minors on an adventure tour. Next Escape does not provide supervision or childcare services and expressly disclaims any liability for the care of minors.

• Documentation: The accompanying adult is solely responsible for securing all necessary legal consents, unabridged birth certificates, and parental authorisations required for any of the activities, and assumes full responsibility for bearing any costs, delays, or cancellations incurred due to regulatory non-compliance.

• Liability and Behaviour: Each adult included in a booking that involves minors is jointly and severally responsible for managing the behaviour, safety, and overall well-being of the minor(s) throughout the duration of the adventure tour. Furthermore, they are responsible for accepting these Terms and Conditions on behalf of the minor(s), which includes the full assumption of operational risks and all liability limitations.

Itinerary Amendments
Adventure travel is inherently unpredictable. Next Escape reserves the right to modify itineraries, products, or services before or during an activity due to operational needs or safety concerns. Changes can occur at short notice. Because of these unpredictable circumstances, Next Escape cannot offer refunds, credits, or price reductions for altered or unused portions of your adventure tour.

Unpredictable factors include, but are not limited to:

• Weather and Nature: Extreme weather, natural disasters, or environmental hazards
• Health and Safety: Injury, sudden illness, pandemics, or medical emergencies
• Logistics: Mechanical breakdowns, transport delays, flight cancellations, strikes, or sudden park closures
• Legal and Political: Civil unrest, political events, or government restrictions

Safety is the absolute priority of Next Escape. If an activity must be halted, a descent initiated, or the final goal or summit abandoned due to safety concerns or a participant’s inability to proceed, no refunds, credits, or price reductions will be issued. Next Escape will not compensate guests for unreached destinations or incomplete itineraries resulting from these mandatory safety turn-backs.

While Next Escape will make reasonable efforts to provide suitable alternative arrangements where possible, the company is under no obligation to substitute, replicate, or compensate for specific activities or destinations removed from the itinerary.

Indemnity
Most outdoor adventure activities involve inherent risks to you, others, and property, which may pose a threat to your health and safety. Consequently, all participants are strictly required to complete and sign a specific Indemnity and Liability Waiver prior to joining any activity or travel. Because this form is tailored directly to the unique nature and location of your specific itinerary, it will be provided to you shortly after your booking is confirmed.

Behavioural Misconduct
To ensure the safety and enjoyment of all participants, you must follow the rules, safety procedures, and instructions of Next Escape staff at all times. Next Escape staff, leaders, or guides reserve the right to terminate your participation immediately, without a refund or credit, if you engage in behavioural misconduct.

Behavioural misconduct includes, but is not limited to:

• Being under the influence of drugs or alcohol during activities
• Causing danger, distress, injury, or severe annoyance to others
• Public nudity or wearing inappropriate, offensive clothing
• Engaging in horseplay, reckless behaviour, or “horsing around”
• Littering or deliberately damaging the natural environment
• Refusing to follow official group rules, safety protocols, or guide instructions

Marketing and Media Release

Next Escape regularly captures photographs, videos, and digital media during our tours for use in promotional materials, social media, and marketing campaigns. By participating in our tours, you grant Next Escape a perpetual, royalty-free, worldwide licence to utilise this media containing your likeness, unless you opt out.

• Your Right to Opt Out: If you do not wish to be photographed or filmed, or do not want your image used for marketing purposes, you have the absolute right to decline. You must notify Next Escape in writing prior to tour departure or inform your adventure guide before activities begin. Next Escape will respect your preference and ensure your likeness is not published.
• Strict Policy on Minors: To ensure the safety and privacy of children, Next Escape maintains a strict zero-tolerance policy regarding the promotional use of minors’ images. Under no circumstances will photographs or videos of participants under the age of 18 be used, posted, or published in any Next Escape marketing, advertising, or social media content.

Peer-to-Peer Media and Privacy Disclaimer
Next Escape encourages participants to capture and share memories of their adventure. However, guests are independently responsible for respecting the privacy of their fellow travellers. If you take photographs or videos of other participants during a tour, you must obtain their verbal consent before uploading or sharing those images on public social media platforms. Next Escape acts solely as a tour operator and expressly disclaims any liability, legal responsibility, or involvement in privacy disputes, defamation claims, or POPIA violations arising from media shared independently by tour participants.

Applicable Law
This agreement and all aspects of your booking or tour are governed solely by South African law. By confirming your booking, you agree that any legal proceedings or disputes relating to these Terms must be brought exclusively before the courts of South Africa. This choice of law does not prejudice your mandatory statutory consumer rights in your country of permanent residence.
